GRANDPARENT POWER OF ATTORNEY AND CARETAKER AFFIDAVITS

House Bill 130 effective July 20, 2004, creates a power of attorney and caretaker affidavit allowing grandparents to obtain "care, physical custody, and control" over the grandchildren without having to go through the process of changing legal custody.

The new R.C. 3109.51 creates a power of attorney signed by a parent authorizing a grandparent of a child with whom the child is residing the right to enroll the child in school, to obtain information about the child from the school, to consent to all school related matters regarding the child, and to consent to medical, psychological, or dental treatment for the child.  The parents of the child must sign the power of attorney and give notice to the noncustodial parent.

R.C. 3109.66 creates a Grandparent Caretaker Authorization Affidavit to be used by the grandparent caretaker of the child when they are unable to locate or contact the parent of the child or where the parental rights of one of the parents have been terminated and the other parent cannot be located.
