RELEASE OF ASSETS WITHOUT WILL

Procedure:

• An application to Relieve Estate from Administration and other forms must be filed, we also require copy of death certificate, funeral bill, appraiser’s receipt if appraisal is required.
• If funeral bill was not paid in full, we require a copy of funeral bill and waiver of notice of Application to Relieve Estate from Administration, Form 5.2, signed by funeral director of the funeral home.
• If real estate is to be appraised, please submit Form 3.0, Application for Appointment of Appraiser form, marked Possible Release, so Judge Klammer may appoint an appraiser. Copy of form will be returned with appraiser’s name, address, and phone number for attorney or applicant to schedule an appraisal. Appraiser needs to sign form 5.1, Assets&Liabilities form, plus a paid receipt from the appraiser is required at the time of filing release.
• Real estate value using current Auditor’s Evaluation may be used for real estate if all heirs and fiduciary sign written consent, and the fiduciary provides the current Auditor’s evaluation
• If real estate is being transferred through the release, estate tax return should be filed in duplicate, if applicable; and Estate Tax form 22, Certificate of Estate Tax Payment and Real Property Disclosure for dates of death on or after November 8, 1990 filed singularly at time of filing release. The Court will not issue a Certificate of Transfer before the filing of an estate tax return.
